The judge failed to comply with the law and maintain competence in the law in the handling of an Application of Writ of Habeas Corpus and Motion for DNA testing in a criminal case, and failed to provide the defendant’s attorney the opportunity to be heard before the judge signed the order denying the Motion to DNA testing and the State’s Amended Proposed Findings of Fact and Conclusions of Law. [Violation of Canons 2A, 3B(2) and 3B(8) of the Texas Code of Judicial Conduct.]
