The judge failed to accord a divorce petitioner the right to be heard when she dismissed his divorce petition for "want of prosecution" on two separate occasions without giving him the opportunity to appear. By failing to make an appropriate inquiry to determine whether the party intended to prosecute his default divorce case and/or whether he had made timely and appropriate attempts to appear in court to have his case heard, the judge denied him his fundamental right to access to the court.
