After the defendant failed to answer a small claims suit, the judge scheduled a default judgment hearing to determine the amount of damages to award the plaintiff. However, nearly one month prior to the scheduled hearing, without notice to the parties, the judge entered a default judgment finding that the plaintiff was not entitled to recover any damages.
